question:

why don't sex discrimination laws automatically cover gender identity & expression? i.e., why doesn't a person with a penis have just as much right to wear a dress as a person with a vagina does? to tell them otherwise is still discrimination based on sex...

I keep trying to answer this, and in so doing, I keep refuting my potential answers. At the base of this debate, I think, is "simply" a difference in moral value. Moral value, in general, should not be written into laws, but it is also extremely difficult to "prove" or change.
